1. Agreement to Terms
By accessing or using SwiftCal at swift-cal.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
SwiftCal is operated by SwiftCal ("we", "our", or "us"). These Terms apply to all users of the Service, including hosts who create booking pages and guests who book appointments.
2. Description of Service
SwiftCal is a scheduling platform that allows users to create customisable booking pages, manage availability, accept bookings, and collect payments. The Service integrates with third-party services including Google Calendar and Stripe.
3. Account Registration
To use the Service as a host, you must create an account using Google OAuth. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorised access to your account
- Accept responsibility for all activity that occurs under your account
You must be at least 16 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions and Billing
4.1 Free and PRO Plans
SwiftCal offers a free tier with core scheduling features and a PRO plan with additional capabilities. PRO plan pricing and features are detailed on our pricing page.
4.2 Payment Terms
PRO subscriptions are billed monthly or annually in advance via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel. All fees are stated in USD unless otherwise indicated.
4.3 Cancellation
You may cancel your PRO subscription at any time through the billing settings in your account. Upon cancellation, you will retain access to PRO features until the end of your current billing period. No refunds are provided for partial billing periods.
4.4 Price Changes
We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price increase. Continued use of the Service after a price change constitutes acceptance of the new pricing.
5. Booking Payments (Stripe Connect)
Hosts may collect payments from guests for bookings using Stripe Connect. By enabling payments, you agree to:
- Comply with Stripe's Connected Account Agreement
- Set fair and transparent pricing for your services
- Honour the refund and cancellation policies you configure for your event types
- Provide the services that guests have paid for
SwiftCal facilitates payment processing but is not a party to the transaction between hosts and guests. Disputes regarding services provided by hosts should be directed to the host in the first instance.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Send spam, unsolicited messages, or fraudulent communications
- Impersonate another person or entity
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorised access to the Service or other users' accounts
- Use the Service for any illegal, harmful, or abusive purpose
- Scrape, crawl, or use automated means to access the Service without permission
We reserve the right to suspend or terminate your account if you violate these terms.
7. Intellectual Property
The Service, including its design, features, and content, is owned by SwiftCal and protected by intellectual property laws. You retain ownership of any content you create or upload through the Service, including event type configurations and booking data.
By using the Service, you grant us a limited licence to use, store, and process your content solely for the purpose of providing the Service to you.
8. Third-Party Integrations
The Service integrates with third-party services including Google Calendar, Stripe, and Resend. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or reliability of third-party services.
You may revoke access to connected services at any time through your account settings or through the third-party service directly.
9. Limitation of Liability
To the maximum extent permitted by law, SwiftCal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not warrant that any bookings, payments, or calendar events will be processed without error.
11. Termination
You may terminate your account at any time by deleting it through the account settings. We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
Upon termination, your right to use the Service will cease immediately. We will delete your personal data in accordance with our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
